AITube – Prompt Battles Terms Addendum

Voluntary Participation

Participation in Prompt Battles is voluntary and at your own risk. You must have an active AITube account in good standing to submit content.

Eligibility

AITube may set age restrictions, geographic limitations, or additional eligibility requirements for specific Battles. AITube may disqualify participants at its discretion.

User Content

Any text, audio, video, images, prompts, ideas, concepts, or other material submitted or generated by you in connection with a Prompt Battle ("Battle Content") constitutes User Content under the Terms and is subject to all licensing provisions therein and in this Addendum.

Public and Non-Confidential

All Battle Content is considered public, non-confidential, and may be accessible to other users, Sponsors, advertisers, and third parties.

Platform License

By participating, you grant AITube a worldwide, perpetual, irrevocable, royalty-free, transferrable, and sublicensable license to use, reproduce, adapt, distribute, display, broadcast, publish, and create derivative works from your Battle Content for any purpose, including:

• •operating and improving the Service;
• •marketing, promotional, or commercial use;
• •training or fine-tuning AI/ML models;
• •licensing such content to third parties for their model training or commercial use;
• •publishing on AITube's channels, partner channels, or media outlets.

AI Model Training

You acknowledge and agree that AITube may use Battle Content—and any associated metadata, inputs, prompts, and interactions—to train, evaluate, improve, or develop artificial intelligence models, including LLMs, generative video models, and machine-learning datasets. AITube may also license Battle Content to third parties for similar purposes.

Sponsored Battles

Some Prompt Battles are sponsored by brands, businesses, agencies, advertisers, or other third parties ("Sponsors").

Commercial License to Sponsors

If you participate in a Sponsored Battle, you grant the Sponsor a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, display, reproduce, publish, adapt, broadcast, distribute, and otherwise exploit the top three (3) winning submissions (as determined by AITube or the Sponsor), for any commercial purposes, including but not limited to:

• •television commercials
• •online paid advertisements
• •billboard/digital signage
• •social media campaigns
• •brand promotions
• •product marketing
• •corporate events

No Additional Compensation

Sponsors are not required to provide any compensation beyond the prize(s) explicitly announced for the Battle.

Selection Process

AITube may determine winners using votes, algorithms, internal review, sponsor selection, or any method it chooses. AITube may change or cancel winner selection at any time.

Disqualification

AITube may disqualify submissions for any reason, including suspected fraud, plagiarism, copyright violations, offensive or illegal content, or violation of this Addendum or the Terms.

Your Promises

You represent and warrant that:

• •You own or have valid rights to all Battle Content.
• •Your submission does not infringe any third-party rights.
• •Your content complies with all applicable laws.
• •You understand your content may be publicly distributed, remixed, or used commercially.

No Harmful Material

You may not submit content that is defamatory, misleading, illegal, hateful, or harmful, or that violates privacy, personality rights, or likeness rights of others.

Your Ownership

You retain ownership of your original rights in Battle Content subject to the licenses granted to AITube and Sponsors.

Derivative Works

AITube and Sponsors may modify, adapt, or create derivative works based on Battle Content, and such derivative works may be owned exclusively by AITube or the Sponsor, at their discretion.
